Team Member FAQ: Moving to Oyster’s Direct Employment Model in Mexico 🇲🇽

We’re excited to share that Oyster has opened its own legal entity in Mexico! This means you’ll soon be employed directly by Oyster instead of through our third-party partner.

We’ve designed this process to be smooth, fully supported, and with no impact on your pay or benefits. Below you’ll find answers to the most common questions about this transition.

What’s the timeline for this change?

The migration process starts in November and all steps — including your resignation from our current provider, signing your new contract, and completing onboarding — must be finished by December 5, 2025. Your new employment with Oyster Mexico will officially start on January 1, 2026.

Your Oyster point of contact will share your individual timeline and guide you through each step.

What do I need to do?

We’ll guide you through each of these 5 steps:

  1. Review this FAQ: This document explains what’s changing, what’s staying the same, and what you can expect.
  2. Review your new employment agreement: Before anything else, you’ll get to review your new contract with Oyster Mexico. You’ll have time to read it and ask questions.
  3. Submit a resignation letter to our current provider: You’ll need to formally resign from our existing employer (our local partner) with December 31, 2025 as your final working day. Don’t worry — we’ll provide a ready-to-use resignation letter template.
  4. Complete your new onboarding form: This quick form helps us confirm your personal and employment details for the new setup and ensure the information we have is up to date. 
  5. Sign your new contract with Oyster Mexico: Once your resignation is submitted, you’ll sign your new Employment Agreement to make the transition official.

What’s changing — and what’s not?

  • What’s changing: You’ll now be employed directly by Oyster Mexico, rather than by our current local partner. This gives you a more streamlined experience and improved support.
  • What’s not changing: Your job, salary, benefits, seniority, and day-to-day work remain exactly the same. There’s no break in your employment or pay.

Why am I being asked to resign? 

We understand this might feel unusual, but it’s simply part of the administrative process. To start your new employment with Oyster Mexico, you’ll need to formally resign from your current employer. This step ensures your existing contract is officially closed so your new one with Oyster can begin smoothly.

We’ll provide you with a ready-to-use resignation template and make sure your new Oyster employment agreement is prepared at the same time.

There will be no break in your employment, and your service date, role, and benefits will continue seamlessly.

Will there be any interruption to my pay or benefits?

No. Your pay and benefits will continue without interruption. You’ll receive your salary and benefits on the same schedule as before, and all statutory entitlements will remain the same.

What happens to any bonuses or commissions I’m owed?

Any bonuses or commissions you’ve already earned will be paid by your current employer as part of your final payroll before the transition. After that, any new earnings will be handled directly by Oyster Mexico under your new employment.

Will I get a new employment contract?

Yes. You’ll receive a new employment agreement directly with Oyster Mexico. You’ll be able to review it carefully before signing. The terms of your employment — salary, benefits, and general conditions — will remain consistent with your current agreement unless discussed otherwise.

Will my start date or seniority reset?

No. Your original start date will continue to be recognized under your new Oyster contract.

This means your tenure, vacation entitlement, and other seniority-based rights remain exactly the same.

No new probation period will be applied.

Will my salary, benefits, or perks change?

No. Everything stays the same. Your salary, bonuses, and perks will carry over exactly as they are today.

If you currently receive meal vouchers, this benefit will continue — we’ll just be transitioning to a new provider. Details will be shared during the migration process.

What happens to my unused vacation days (PTO)?

As part of the transition, your current employer (Oyster’s partner) must pay out any unused vacation days when your contract ends. Vacation balances cannot be transferred to your new Oyster contract.

To make sure this is handled correctly, please double-check that all your time off has been recorded properly. Flag any discrepancies or issues with your People team by November 21, 2025, so everything can be paid accurately in your final payroll.

If you’d prefer to use your remaining vacation days instead of receiving a payout, please plan your time off before the end of November and discuss it with your manager.

Will my payroll schedule change?

No. Your salary, bonuses, and allowances will continue to be paid by Oyster on the same schedule as before. There will be no delays or changes to payment timing.

What are the benefits of being employed directly by Oyster?

Your Oyster point of contact will guide you through every step of this process. You’ll also receive direct communication from Oyster when it’s time to complete each step (like signing your contract or submitting your resignation).
